A 15 year old Chinese boy was allegedly raped on June 8 by a 29 year old local businessman allegedly dragged him into his car at knifepoint and then drove him off and forced him to have sex. After six hours the boy was released.
The alleged perpetrator was caught, but according to Chinese law, rape can only happen to women and not men.
While article 236 of Chinese law defines women as victims of rap and article 237 speak to indecency towards a child, neither protects the boy as he is over the legal defintion of a child. This legal snafu, or maybe it was the fact that the person who was raped was a poor farmer and the man who had allegedly raped him was one of only 6% of the Chinese who can afford to own a car, lead to the alleged perpetrator being held for only 15 days in administration detention.
Upon hearing about the rape, the boys familay had to get involved for the Chinese legal system is such. And the family could find little to support their case. Even after complaining to the authorities about the event, they said that little had happened to the restaurant, even after his car was spotted. One has to remember that in China, cash is king. Although the news make no mention that the suspects money had anything to do with the alleged foot dragging of the authorities, one has to wonder.
In any event, the public heard about the event and was outraged, causing the police to act. Eventually they said they may be able to bring the suspect up on ‘illegal detention charges’. Lets just hope that if he has money, it will not allow him to buy his freedom.
